10. Dispute Resolution

If a dispute arises, our Support Team is ready to assist in resolving the issue. If informal resolution attempts fail and you reside in the United States or Canada, you have the option to pursue resolution through small claims court or binding individual arbitration. You may not initiate the claim in another court or participate in a non-individual class action against us.

This Dispute Resolution section ("Dispute Resolution Agreement") applies solely to residents of the United States or Canada. We encourage resolving disputes informally before pursuing formal legal action.

10.1 Dispute Resolution Overview

Correct Hustle is dedicated to resolving disputes with users without resorting to formal legal claims. In the event of an issue, both parties agree to make diligent efforts in good faith to reach a fair and equitable resolution through the mandatory informal dispute resolution process outlined below. Occasionally, involving a third party may be necessary to resolve disputes, and this agreement governs how such disputes are handled.

Both you and Correct Hustle agree that any disputes, claims, or controversies arising from or related to these Terms must be addressed solely through small claims court or binding individual arbitration if not resolved informally. You also waive the right to a jury trial and to file a case in any other court. Furthermore, both parties agree to bring claims against each other only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.

This agreement applies to both parties and their respective agents, attorneys, contractors, subcontractors, service providers, employees, and others acting on their behalf. It is binding on both parties heirs, successors, and assigns and is governed by the Federal Arbitration Act.

10.2 Mandatory Informal Dispute Resolution Process

Before initiating a formal claim, both parties must engage in the informal dispute resolution process described below:

  • The claiming party must send a short written statement ("Claim Statement") to the other party, including their full name, mailing address, email address, the nature and details of the dispute, and a proposal for resolving it.
  • Sending a Claim Statement tolls any applicable statute of limitations for 60 days from the date of receipt.
  • If the dispute remains unresolved after 60 days, either party has the right to initiate a formal claim in small claims court or individual arbitration.

Failure to complete this process constitutes a material breach of the Terms, and no court or arbitrator will have jurisdiction to hear or resolve any disputes between the parties.

10.3 Small Claims

Disputes that are not resolved through the informal dispute resolution process can be brought to small claims court in San Francisco, California, the county where you reside, or another agreed-upon location. Both parties waive the right to bring disputes in courts other than small claims court.

10.4 Arbitration

As an alternative to small claims court, disputes can be resolved through individual arbitration. The arbitrator has the authority to award the same relief as a court, and all court proceedings must be paused pending arbitration. Any disagreements regarding arbitration, including its necessity and enforceability, will be resolved by the arbitrator.

If the designated arbitration organization is unable to administer the arbitration, both parties will negotiate in good faith to find a suitable alternative. If no agreement is reached, either party may petition a court to appoint an organization or individual to conduct the arbitration.

10.5 General Arbitration Rules

The arbitration process varies depending on whether the claim is pursued individually or as part of a Mass Arbitration. These rules govern the arbitration process unless a Mass Arbitration is involved.

All arbitrations will be conducted before a single arbitrator, with proceedings initiated by filing an arbitration demand with the AAA. The specific arbitration rules depend on whether the arbitration involves consumers or other parties.

10.6 Mass Arbitration Rules

Special rules apply if 25 or more claimants file substantially identical disputes against Correct Hustle. These rules outline a bellwether procedure and mandatory mediation process to resolve Mass Arbitration claims.

10.7 Fees and Costs

Each party is responsible for its own costs and attorneys fees in a dispute, with exceptions made for cases of bad faith or frivolous claims.

10.8 No Class Actions

Both parties agree to resolve disputes on an individual basis and waive the right to participate in class actions, consolidated actions, or representative actions. Arbitrators cannot combine multiple claims into a single case, and their decisions only apply to the disputes of individual users.

10.9 Changes

Users have the option to reject changes to the Dispute Resolution section within 30 days of notification. Rejecting changes indicates agreement to arbitrate any disputes in accordance with the provisions in effect at the time of the last acceptance of the Terms.

10.10 Improperly Commenced Arbitration

If a party believes arbitration has been initiated in violation of the Dispute Resolution Agreement, they may seek an injunction from a court of competent jurisdiction to halt the arbitration and recover associated fees and costs.

11. Updating These Terms

Correct Hustle reserves the right to modify these Terms at any time, with changes becoming effective upon posting unless otherwise stated. Users will be notified of material changes via email or through the Services. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
